Philip - your consultant contact may also be interested in a brief study that I carried out a few years back here at Cranfield in the UK. Supported by IP insurers Miller (particularly Ian Lewis, now CEO of Samian Underwriting) I looked at patent invalidity in the UK and US courts and possible contributing factors. The study was reported in Managing Intellectual Property, October 2002, pp65-69 and was intended to help IP managers in managing invalidity risk and explaining it to senior management.
